Still In Jail

So, good reader, take a look at the following story and tell me WHY this guy is still in jail! And, please, don’t tell me "rules are rules" and "laws are laws". They are.  But that’s far to simplistic a view for what’s happening here.  My simple answer to my own question is, "He shouldn’t be".
